MEDIATION
Mediation is a voluntary and confidential process in which a neutral third party, known as the mediator, facilitates communication and negotiation between disputing parties. The goal is to help the parties reach a mutually acceptable agreement.
The Mediator Role
The mediator does not make decisions or impose solutions but assists the parties in identifying issues, exploring options, and finding common ground. The process is collaborative and empowers the parties to control the outcome.
ARBITRATION
Arbitration is an extrajudicial proceeding, usually governed by an arbitration agreement between the parties. A neutral third party, known as the arbitrator, is appointed by the parties to issue a binding decision on the dispute. The arbitrator conducts a hearing, reviews evidence, and issues a decision, which is generally enforceable in court. The scope of the arbitrator’s authority is typically defined by the terms outlined in the arbitration provisions in a contract.
Arbitrator role
Unlike mediation, the arbitrator has the authority to render a decision, and the outcome is legally binding. Arbitration is often chosen as an alternative to litigation for its efficiency and flexibility.
NEUTRAL EVALUATION
Neutral evaluation is a non-binding process in which a neutral third party assesses the strengths and weaknesses of each party's position in a dispute. This neutral evaluator provides feedback to help the parties assess the merits of their claims and potentially facilitate an early settlement.
the Neutral Evaluator role
The neutral evaluator provides an informed assessment of the case, offering insights into potential trial outcomes. Importantly, the evaluation is advisory only. The parties retain control over the decision to further pursue or defend the dispute.
