MEDIATION
Mediations are typically scheduled for full and half-day sessions at a fixed rate. This fixed fee includes all preparation, pre-mediation discussions, and reasonable post-session follow-up discussions. Additional sessions may be scheduled at a standard hourly rate or at an agreed fixed fee.
Payment of the fixed fee for full or half-day mediation sessions is required before the mediation is held. Payment of all invoices is required within 30 days of issuance.
All fees are divided equally between the plaintiff(s) and defendant(s) or pro rata among the parties where appropriate or by separate agreement of the parties.
Fees may be adjusted to accommodate the circumstances of a particular dispute, including pro bono where appropriate.
ARBITRATION
All pre-hearing and post-hearing time is billed at a standard hourly rate or at an agreed fixed fee. Evidentiary hearings are billed per hour. All fees are divided equally between the claimant(s) and respondent(s), pro rata among the parties where appropriate, or according to the agreement of the parties. A deposit will typically be required at the time of scheduling. Payment of all invoices is required within 30 days of issuance.
neutral evaluation
Counseling services are billed at a standard hourly rate or at an agreed fixed fee based on the scope of the engagement. A retainer sufficient to cover expected fees and costs will be requested.
fees & costs
Any travel time over one hour per day is charged per hour.
A cancellation charge will be applied if the matter is canceled less than 14 days in advance of any scheduled mediation or arbitration, unless immediately rescheduled. A retainer/deposit will typically be required at scheduling.
All out of pocket expenses incurred in connection with a retained matter will be billed at cost.
Fees and costs are the joint and several obligations of the attorneys and parties on each side who retained COX ADR.
